Class Action Waiver

CheaterSpoiler provides investigative tools including online dating profile searches and reverse image lookups, all accessible under a consistent set of terms, structure, and payment options. These Services are designed to generate reports that may include publicly available information and licensed data obtained from third-party data providers. Report contents may include, but are not limited to: full names, social media profiles, profile photos, interests, bios, last known activity, gender, and location history. Users understand and accept that data accuracy and availability may vary depending on the sources accessed.
Our Services are intended solely for personal, informational purposes and are not suitable for decision-making processes in regulated or critical areas such as employment screening, tenant vetting, credit evaluation, or legal assessments. By using our Services, you agree to use the information responsibly and in accordance with all applicable laws and regulations.
Access to Services is available through the following payment options:
• 3-Day Trial: Begin with a paid 7-day trial that unlocks 1 search request. After the trial ends, you may choose to continue with a weekly or monthly subscription.
• Weekly Subscription: Unlocks and tracks 1 search request per week.
• Monthly Subscription: Unlocks and tracks 1 search request per month.
• Annual Subscription: Unlocks and tracks 1 search request per year.
One-Time Purchases may include:
• Single Search Unlock: One report without ongoing tracking.
• PDF Download Option: Enables downloading of reports in PDF format.
• Sex Offender Background Check: Allows U.S.-based searches for publicly available information on registered sex offenders.
CheaterSpoiler relies on two data sources:
1. Open Source Intelligence (OSINT): Publicly accessible data gathered legally and ethically from sources such as social media, news articles, public databases, and government records.
2. Licensed Data: Professionally sourced data from third-party providers.

Accounts and Login
To access and use certain features of the Services, you may be required to create an account on the CheaterSpoiler app or website (“Profile”) and provide accurate personal information as prompted during the registration process.
By creating a Profile, you represent and warrant that:
(i) all information you provide is truthful, accurate, and complete;
(ii) you will keep your information up to date; and

Access to CheaterSpoiler is for individual use only. You may not create multiple accounts using different email addresses, nor may you transfer or share your account with another person or organization without our express written consent. We reserve the right to refuse, restrict, or revoke access if we detect suspicious, fraudulent, or prohibited behavior.
By using our Services, you confirm that you are at least 18 years old and legally capable of entering into these Terms. You agree to use the Services lawfully and responsibly in accordance with all applicable regulations.
We may restrict access to certain features or functionality based on your subscription level, trial status, or account activity. It is your responsibility to ensure that your use remains within the limitations defined by your account tier and these Terms.
Account Deletion and Data Removal
You have the right to permanently delete your CheaterSpoiler account and all associated data. To do so, visit the designated Account Deletion page and enter the email address linked to your account. For verification purposes, a one-time password (OTP) will be sent to your email. Once verified, the deletion request will be processed, and all account data—including stored email addresses, personal data, and remaining search credits—will be permanently removed from our systems.
Once deleted:
• You will no longer be able to log in using the deleted email address.
• Any remaining credits will be forfeited.
• You may create a new account in the future using the same email address.
Note: For security reasons, deletion requests must be submitted via the official account deletion page. Our Customer Support team will direct users to this page and will not process deletion requests manually.

License and Permitted Use
Subject to your full compliance with these Terms, CheaterSpoiler grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services strictly for your personal, non-commercial purposes. This license is provided solely as outlined in these Terms and does not confer any ownership rights to the Services, underlying content, or any data accessed through the platform.
You agree to use the Services only as intended and in accordance with all applicable laws and regulations. Prohibited activities include, but are not limited to:
• Scraping, extracting, or harvesting data or content from the platform
• Reproducing, distributing, modifying, translating, or reverse-engineering any part of the Services
• Attempting to gain unauthorized access, disrupt functionality, or bypass security measures

This license remains in effect only while you comply with these Terms. • Automatically converts to the selected subscription plan unless canceled before the trial ends.

Weekly Subscription

• Recurs automatically every 7 days after trial expiration.
Monthly Subscription

Billing and Payment
• All major credit/debit cards and select local payment methods are accepted.

Failed Payments:
In the case of a failed transaction, we will retry billing multiple times over a 30-day period. If payment remains unsuccessful, your account may be suspended and access to Services restricted until payment is resolved.
Refund Policy
Trial Refunds
• The $1.99 USD trial fee is refundable only if requested within 3 days of the original purchase.
Subscription Refunds
• Non-refundable, except in these limited circumstances:
• Prolonged service outage exceeding 24 consecutive hours (excluding scheduled maintenance or force majeure).
• Billing errors (e.g., duplicate charges or incorrect billing amounts).
• Refund requests must be submitted within 30 days of the transaction.
• Requests must include your account email, transaction details, and reason for the request.
• Approved refunds are processed to the original payment method within 3–5 business days.
Not Eligible for Refund:
• Partial or unused time after cancellation
• Changes to subscription plans or features
• Failure to cancel before renewal
International Pricing and Currency Conversion
• Pricing varies by region and may be subject to exchange rates and local promotions.
• Where local currency support is unavailable, purchases will be processed in USD, and your bank or card issuer may apply conversion fees.
Regional Notes:
• UK/EU: Prices shown and billed in local currency.
• Australia/Canada: Prices converted from USD to AUD or CAD at the time of the transaction.
• Other countries: Charges are shown in USD and converted at the prevailing international exchange rate.

Cancellation
You may cancel your subscription to the Services at any time using the following method:
Self-Service Cancellation
To cancel your subscription:
• Visit our Help Center and navigate to the Cancellation page.
• Log in using the email address associated with your account.
• Follow the steps to schedule your cancellation for the next billing cycle.
If your weekly subscription renews on January 1 and you schedule cancellation on January 3 (without using any credits), your cancellation will take effect at the beginning of the next billing cycle.
Important Notes:
• Your subscription will remain active until the end of the current billing period.
• Failure to follow the outlined steps may result in continued charges, for which you will be responsible.

Data Privacy

Dispute Resolution

3. Binding Arbitration

• Proceedings may be conducted virtually.
• Arbitration must be initiated within six (6) months of the dispute arising.
• Filing fees and arbitrator costs will be shared equally unless otherwise awarded.
• Each party is responsible for its own legal fees, unless the arbitrator decides otherwise.
4. Exceptions to Arbitration
The following types of claims are not subject to arbitration and may proceed directly to the appropriate forum:
• Intellectual property disputes,
• Claims filed in small claims court,
• Requests for emergency injunctive relief.
All other disputes must follow the full resolution process prior to initiating court proceedings.
5. Class Action and Consolidation Waiver
Class actions, collective proceedings, and consolidated claims are strictly prohibited. All arbitration and legal actions must be brought on an individual basis.
By using the Services, you acknowledge and agree to comply with this dispute resolution process, including the mandatory arbitration requirement and waiver of class or representative actions.
Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of England and Wales, without regard to any conflict of law provisions.
1. Jurisdiction (UK Users)
• Any disputes, claims, or legal proceedings arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
• You waive any objection to the jurisdiction or venue of such courts on grounds of inconvenience or otherwise.
2. International Users

• Where local law permits, disputes shall be governed by the laws of England and Wales, and resolved in the courts of England and Wales.
• For users located in the EU or EEA, you may also bring a claim before the competent courts in your country of residence, if required by applicable consumer protection laws.
3. Right to Equitable Relief
We reserve the right to seek injunctive or equitable relief in any court of competent jurisdiction if necessary to protect our intellectual property rights or enforce these Terms.
4. Time Limit to Bring Claims
• Any claim or cause of action arising from or related to your use of the Services must be filed within six (6) months from the date on which the claim arose. After this period, such claims shall be permanently barred.
